Wasn’t Harvey Weinstein partying in Manhattan over a year ago? Strange how many things can go awry with one’s health in the weeks before a rich person’s sentencing hearing.

According to USA TODAY, on Sunday, the convicted sex offender fell and hit his head while trying to walk rather than use his wheelchair in jail, according to his representative.

Weinstein is supposed to be sentenced on Wednesday after being found guilty of two sex crimes during his February trial. His spokesman claims that Weinstein has expressed remorse after a trial judge received a catalog of alleged bad behavior compiled by prosecutors.

It seems as if Weinstein’s case is a bit similar to Bill Cosby’s: as sentencing advanced, he progressively started to show more and more of a “crippling” demeanor. Harvey’s lawyers will probably argue that keeping him in jail when his health is so bad is cruel and unusual punishment and request his release.

The convicted sex offender, who is due to be sentenced Wednesday after being found guilty of two sex crimes last month, has expressed some remorse through his spokesman, apparently in response to a catalog of alleged bad behavior compiled by prosecutors for his trial judge.

Weinstein was transferred from Bellevue Hospital in Manhattan last week to the infirmary at the New York City jail on Rikers Island after an operation on his heart to remove a blockage, according to jail records.

Weinstein’s representative, Juda Engelmayer, told USA TODAY on Monday that Weinstein shares a cell “with two other older gentlemen” and follows the same schedule as others in Rikers.

Engelmayer was unable to provide further updates on Weinstein’s medical condition because he doesn’t “get much phone time with him,” but he noted Weinstein resides in the infirmary ward. [USA Today]

Harvey is doing everything he can to get out of Rikers and back into the relative luxury of a hospital environment. Nothing doing. This is all a subterfuge orchestrated by Weinstein and his team to get him out of jail: free.

Remember when Michelle Obama praised Harvey: “I want to start by thanking Harvey Weinstein for organizing this amazing day. Harvey. This is possible because of Harvey. He is a wonderful human being, a good friend, and just a powerhouse.” I bet she wished she had that back.

I will say this: It makes sense that dealing with the stress of possible jail time and having your public perception destroyed can amount to a lot of stress which would affect your health.

That said, I do not believe him either—I’m convinced he’s guilty and deserves to do the time to which he was sentenced.
