The homeless veteran who became a viral sensation after he used his last $20 to fill up the gas tank of a stranded motorist in Philadelphia is now suing the couple who led the charge in a fundraising campaign that raised $400,000 for him.

Johnny Bobbitt believes that Mark D’Amico and Katie McClure mismanaged part of the donations they raised for him. The couple, who hails from New Jersey, has denied the charges against them, saying that they were wary of giving Bobbitt large sums because they feared he would buy drugs.

The lawsuit claims that D’Amico and McClure committed fraud by taking money from the fundraising campaign for themselves.

“I think it might have been good intentions in the beginning, but with that amount of money, I think it became greed.” Bobbitt said.

It all started when Bobbitt came to McClure’s aid after she ran out of gas on an Interstate 95 exit ramp late one night. He walked a few blocks to get gas for her because she did not have money to pay for it at the time. Days later, she sought him out and repaid him, and she visited him a few more times to bring food and water. McClure also started the GoFundMe page for him, and the two appeared on shows like “Good Morning America” together.

However, their relationship has since taken a turn for the worse.

Christopher C. Fallon, one of Bobbitt’s lawyers, said that he was left with no other option but to sue after D’Amico who ignored multiple requests for a full accounting of the money raised by the GoFundMe campaign.

“He’s really left us with no choice but to go forward,” said Fallon.

In addition, the couple bought Bobbitt a camper with some of the money and allowed him to park it on a property that the McClure family owns. However, he was rendered homeless again in June when D’Amico told him that he had to leave the property.
