Lawyers representing the disgraced Hollywood mogul Harvey Weinstein are speaking out this week to portray the 69 year-old’s life in prison as a living Hell for him, claiming that he is legally blind, has lost four teeth, and is battling various other health issues.

They are using this as their argument as to why Weinstein should not be extradited to Los Angeles to face sexual assault and rape charges, claiming that his health is rapidly deteriorating.

Weinstein’s lawyers made these arguments during a hearing in Buffalo, New York on Monday, according to Variety. This was only the second time that Weinstein himself had appeared in court since he was sentenced to 23 years in prison for rape and sexual assault charges in March of last year.

Weinstein used a walker to get around, but he was seen smiling as he chatted with his attorneys before the hearing began. He barely had to speak during the hearing, only doing so to answer a few simple questions from the judge.

Los Angeles prosecutors are fighting to have Weinstein extradited to California so that they can put him on trial on 11 charges, which could bring up to 140 years in prison. Over the last year, the extradition process has been delayed multiple times due to the COVID-19 pandemic.

The latest move made by the L.A. prosecutors was to file a sealed indictment against Weinstein. While this indictment mirrors the charges that have already been filed, it also lets prosecutors avoid an evidentiary hearing, which would slow down the process.

Norman Effman, one of Weinstein’s lawyers, fired back on Monday by arguing that the indictment means that the extradition request is now out of date.

“I have nothing on the indictment level that shows that a judge signed this request,” Effman said.

Effman went on to suggest that Weinstein should be able to stay in New York and be tried virtually from Los Angeles, but he said that this request had already been turned down.

“We know where he is,” Effman said. “He’s not going anywhere.”

Not stopping there, Effman claimed that Weinstein is suffering from multiple serious medical issues that require serious and complicated treatment. He alleged that the former Hollywood producer has dental problems that has seen him have four teeth removed, and that he is also experiencing cardiac issues, back issues, sleep apnea, and is nearly legally blind.

Erie County D.A. John Flynn lashed out after the hearing, accusing Effman of engaging in a “sandbag move.”

“Obviously it’s a stalling technique,” Flynn said. “He wants to keep his guy here as long as possible, and prevent him from going to California to face what he’s accused of out there.”

The judge set another hearing date of April 30 to hear further objections.
