Meghan Markle was just given some bad news in her privacy lawsuit against a British newspaper as a top legal expert has warned her that things are going to get very messy for her in court.

Meghan is suing Associated Newspapers for publishing a letter that she had written to her father Thomas Markle that she claims was meant to be confidential. Legal expert Amber Melville-Brown, head of media and reputation at legal firm Withers, told Fox News that the drama of the case will undoubtedly increase tenfold if and when Meghan and her father will testify against one another.

“The big battle is going to be between Meghan and her dad. That will be horrible for both of them, I suspect,” Melville-Brown said. “This case is all about if [Meghan] had a reasonable expectation of privacy. This means she’ll have to give evidence as to what she did with the letter and the impact [the publishing of it] had on her. The court won’t know how deeply distressing this is to her unless she gives evidence.”

Meghan is suing Associated Newspapers for copyright infringement and misuse of private information, arguing that in publishing the letter, the publisher violated the U.K.’s data protection act. Melville-Brown, who is certified to practice law in both the U.K. and U.S., warned that while protecting the privacy of clients is important, Meghan has already “overbaked the litigation cake” by taking news coverage too personally. She added that even if Meghan is victorious in the lawsuit, it won’t stop the public from being interested in her and her life.

“Meghan and Harry have made it personal for them,” the lawyer explained. “Harry already had a completely understandable hatred of the press because of the role he believes they played in his mother’s death. It’s clear the couple has gotten to the end of their tether, but making the case personal doesn’t mean they can win the war.”

Melville-Brown went on to warn Meghan that in order for her to be successful in her lawsuit, she has to be prepared “for all the publicity that comes with it.”

“When you bring an action for privacy invasion it’s sometimes a dangerous thing to do. Meghan and Harry have painted themselves into a corner because, as they’re attempting to gain control of their image and protect their privacy, she will also have to speak to it,” the lawyer said. “She is opening up the possibility of being cross-examined in open court.”

This comes after we reported that Meghan suffered a defeat in court earlier this month when a judge tossed out her claims that Associated Newspapers acted dishonestly and attempted to make further conflict between her and her dad. Melville-Brown said that she sees this as “more than a slight setback.”

“The first win in the war is an important one,” she said. “Psychologically, it’s very important as a litigator because it sets the tone for the case.”

The lawyer concluded by saying that if Meghan wants to win this lawsuit, she needs to keep her arguments “very narrow” and leave her personal issues with the media out of the case.
